Fact Sheet: Israeli Administrative Detention Against Palestinians

Introduction:

The Israeli occupation authorities continue their escalating violations against the Palestinian people, as the occupation governments pursue the policy of administrative detention against Palestinians in an increasingly unlawful and unethical manner, constituting a violation of the rules of international humanitarian law, in an attempt to break the will of the Palestinian people and subjugate them.

Administrative detention: is the arrest or the incapacitation and restriction of the freedom of Palestinians, occurring on the basis of an administrative order only, without judicial justification or an indictment, and without trial. The occupation authorities claim that administrative detainees have secret files that can never be disclosed, thereby violating the rules of international law in a clear and explicit manner.

This paper aims to shed light on Israeli administrative detention against Palestinians, which has escalated rapidly in recent years, due to the rising state of struggle in the Palestinian territories in confronting the Israeli occupation forces. The problem of the study lies in addressing the policy of administrative detention by the Israeli occupation forces against Palestinians, and identifying the nature of administrative detention under international law, the legal and historical background of Israeli administrative detention, and the reality of Israeli administrative detention against Palestinians.
